Terms of Service

These Terms of Service govern your access to and use of the Beaver Hardwood website and your interactions with Beaver Hardwood. Throughout these Terms, “Beaver Hardwood,” “we,” “us” and “our” refer to Beaver Hardwood.

By accessing this website, submitting an inquiry or otherwise communicating with Beaver Hardwood, you agree to these Terms. If you do not agree, please do not use the website.

1. About Beaver Hardwood

Beaver Hardwood is a commission-led furniture studio based in central Ontario. We design and build solid hardwood dining tables, statement tables, architectural commissions, cabinetry, built-ins, workspaces and related custom pieces.

Our website presents examples of previous work, information about our process and general pricing guidance. It is not a conventional ecommerce store, and submitting an inquiry does not create an order or require either party to proceed.

2. Project Inquiries

Information submitted through our inquiry form is used to evaluate the proposed project and begin a conversation.

Submitting an inquiry:

  • does not constitute acceptance of the project;
  • does not reserve production capacity or material;
  • does not guarantee a quoted price or completion date; and
  • does not create a binding contract.

We may decline a project when its scope, timeline, location, budget or design requirements are not suitable for our studio.

3. Quotes and Commission Agreements

A commission becomes binding only when the client has accepted the applicable estimate, proposal, design approval, commission agreement or other written project document and has paid any required deposit.

Project-specific documents may include:

  • dimensions and specifications;
  • material and layout selections;
  • design and base direction;
  • finish selection;
  • pricing and applicable taxes;
  • deposit and payment milestones;
  • delivery or installation requirements;
  • estimated production timing;
  • warranty information; and
  • cancellation or change terms.

If these Terms conflict with a signed or accepted project-specific document, the project-specific document will govern to the extent of that conflict.

Approvals provided by email, electronic signature or another agreed electronic method may be relied upon as written approval.

4. Pricing, Taxes and Payment

Unless stated otherwise, prices are expressed in Canadian dollars.

Applicable taxes, delivery charges, installation costs and other known project charges will be identified in the applicable estimate, invoice or commission agreement. Costs that depend on final location, access conditions, material selection or third-party services will be confirmed before they are incurred or added to the project.

Deposits and progress payments are due according to the payment schedule shown in the project documents. Production capacity and material are not considered reserved until the required payment has been received.

Failure to make a payment when due may delay or suspend design, material allocation, production, delivery or installation.

5. Material Selection and Approval

Natural hardwood varies from one tree, board and slab to another. Colour, grain, figure, sapwood, mineral streaking, knots, checks, voids, live-edge character and other natural features are part of the material rather than evidence of mass-produced uniformity.

Where applicable, Beaver Hardwood will provide photographs, layouts, samples, drawings or other information to support material and design approval before production begins.

Digital photographs and screens may not reproduce colour, scale or texture perfectly. Final material may also change modestly through milling, sanding and finishing.

Once material or a proposed layout has been approved, changes may require additional material, labour, cost and production time.

6. Natural Wood Movement

Solid wood naturally responds to changes in humidity and temperature. Seasonal expansion, contraction and minor movement can occur throughout the life of the piece.

Clients are responsible for maintaining a reasonably stable indoor environment and following the care guidance supplied with the completed work. Damage caused by excessive dryness, humidity, water, direct heat, improper storage, outdoor exposure or failure to follow care instructions is not considered a workmanship defect.

7. Dimensions, Room Fit and Site Information

The client must provide accurate information about the intended room, use, seating requirements and project location.

Where dimensions are supplied by the client, designer, builder or another third party, Beaver Hardwood may rely on that information unless measuring services are specifically included in writing.

The client is responsible for disclosing relevant access conditions, including:

  • doorway, hallway and stair dimensions;
  • elevators and loading areas;
  • tight turns or restricted access;
  • floor and wall protection requirements;
  • construction or renovation activity;
  • parking or delivery restrictions; and
  • any condition that may affect safe delivery or installation.

Additional work, return trips, storage, equipment or modifications arising from inaccurate information or undisclosed site conditions may result in additional charges.

8. Design Changes and Scope Changes

Changes requested after approval may affect material requirements, structural design, labour, price and completion timing.

No material change to the approved scope will be implemented until the effect of the change has been reviewed and, where required, approved in writing.

Beaver Hardwood may decline a requested change when it would compromise structural integrity, material suitability, workmanship, safety or the agreed design direction.

9. Production and Completion Timing

Production dates and delivery windows are good-faith estimates unless expressly guaranteed in writing.

Custom work can be affected by material conditioning, supplier availability, finish-curing time, design changes, transportation, weather, site readiness and other circumstances outside our reasonable control.

We will communicate material changes to the anticipated schedule when they become known. A reasonable schedule adjustment does not by itself constitute a breach or create an automatic right to compensation, except where required by applicable law or agreed in writing.

10. Cancellation and Refunds

Because each commission may involve reserved production capacity, selected material, design work and custom fabrication, cancellations are handled according to the project’s stage and the applicable commission agreement.

Deposits and other payments may become non-refundable after defined project milestones, to the extent permitted by law. Amounts already applied to design work, material purchasing or allocation, outside services, fabrication, storage or other committed project costs may be deducted from any refund otherwise agreed or required.

Custom and made-to-order pieces are not eligible for change-of-mind returns after completion unless Beaver Hardwood agrees otherwise in writing or a return, cancellation or refund is required by applicable law.

Nothing in these Terms limits any cancellation, refund, warranty or other consumer right that cannot legally be waived.

11. Delivery, Collection and Installation

Delivery and installation arrangements will be identified in the applicable project documents.

The client must ensure that the site is accessible, safe and ready at the agreed time. If delivery or installation cannot be completed because the site is inaccessible, unfinished or unsafe, additional transportation, labour or storage charges may apply.

The client or an authorized representative should inspect the piece promptly upon delivery or collection and report visible transportation damage or significant discrepancies as soon as reasonably possible.

Where a third-party carrier is used, delivery procedures and claims may also be subject to that carrier’s terms.

12. Storage

If a completed piece cannot be delivered or collected within the agreed period because of a client delay or site condition, Beaver Hardwood may charge reasonable storage, handling, insurance and rescheduling costs after providing notice.

Extended storage may expose solid wood to environmental conditions outside Beaver Hardwood’s control. Any special storage arrangement should be confirmed in writing.

13. Workmanship and Warranty

Beaver Hardwood stands behind the workmanship of its completed commissions.

Any project-specific warranty, remedy or reporting period will be described in the estimate, invoice, commission agreement or care documentation. We must be given a reasonable opportunity to inspect and address a reported concern before third-party repair work is undertaken.

Warranty coverage does not extend to:

  • normal wear and ageing;
  • natural colour change or patina;
  • expected seasonal wood movement;
  • misuse, impact or abuse;
  • water, heat or sunlight damage;
  • improper cleaning or maintenance;
  • unsuitable humidity or environmental conditions;
  • unauthorized modifications or repairs; or
  • damage caused during relocation by others.

These exclusions do not limit rights or warranties that apply under law and cannot be excluded.

14. Website Images and Information

Images on this website may show previous commissions, studio work, material inventory, design concepts or digitally refined presentation images.

Because each commission is based on unique material and project requirements, previous work is illustrative and does not guarantee that a future piece will have identical grain, colour, dimensions, edge character, proportions or detailing.

We make reasonable efforts to keep website information accurate, but descriptions, availability, starting prices, production timing and service offerings may change without notice.

A website starting price is not a final project price. Final pricing is established through the applicable written estimate or proposal.

15. Photography and Portfolio Use

Beaver Hardwood may photograph work while it is in the studio for documentation, quality control and portfolio purposes.

Photographs inside a client’s home or private property will be arranged with permission. We will not intentionally publish a client’s name, address or other identifying private information without consent.

Clients may advise us in writing if a project is subject to confidentiality requirements.

16. Intellectual Property

The website and its content—including text, photographs, graphics, logos, designs and presentation materials—are owned by or licensed to Beaver Hardwood and are protected by applicable intellectual-property laws.

You may view the website for personal and project-planning purposes. You may not reproduce, distribute, modify, sell or commercially exploit our content without prior written permission.

Drawings, renderings, concepts and design documents created by Beaver Hardwood remain our intellectual property unless a written agreement expressly provides otherwise. Clients may use project documents for their commissioned project but may not reproduce or manufacture the design through another party without permission.

17. Acceptable Website Use

You must not:

  • use the website for unlawful, fraudulent or abusive purposes;
  • attempt to interfere with the website’s operation or security;
  • introduce malicious software or automated scraping tools;
  • impersonate another person;
  • submit knowingly false or misleading information; or
  • use website content in a manner that infringes our rights or the rights of others.

We may restrict access to the website when reasonably necessary to protect the site, our business or other users.

18. Third-Party Services and Links

The website may contain links to third-party services, social platforms, payment providers, carriers or other websites.

Beaver Hardwood does not control those third parties and is not responsible for their content, availability, privacy practices or terms. Use of a third-party service is subject to that provider’s own terms and policies.

19. Electronic Communications

By submitting an inquiry, you consent to receiving communications reasonably related to that inquiry or project by email and, where selected, telephone or text message.

Permission to communicate about an active inquiry is not consent to receive unrelated promotional messages. Marketing communications will be handled according to the consent and unsubscribe requirements applicable to those communications.

Standard telephone, text or data charges imposed by your service provider may apply.

20. Disclaimer and Limitation of Liability

The website is provided for general information and project-inquiry purposes. It is provided on an “as available” basis without a guarantee that access will always be uninterrupted or error-free.

To the maximum extent permitted by law, Beaver Hardwood will not be liable for indirect, incidental, special or consequential losses arising solely from use of, or inability to use, the website.

Liability relating to a specific commission will be governed by the applicable project documents and law.

Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, gross negligence or any statutory consumer right or remedy that cannot lawfully be excluded.

21. Privacy

Our collection, use and protection of personal information are described in the Beaver Hardwood Privacy Policy, which forms part of these Terms.

22. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law principles.

Subject to any consumer right requiring otherwise, disputes relating to these Terms or the website will be submitted to the courts of Ontario.

23. Changes to These Terms

We may update these Terms periodically to reflect changes to our website, services, business practices or legal requirements.

The updated version will be posted on this page with a revised “Last updated” date. Continued use of the website after an update constitutes acceptance of the revised Terms.
